UTAH’S CONSTABLES: FIRST IN LAW ENFORCEMENT

The Office of the Constable has a rich history in Utah. Constables and their deputies were the first law enforcement officers in the Territory of Utah until statehood in 1896 and remain a vital part of our law enforcement community. The role of city and county constables and their deputies serve is to enforce civil and criminal process, conduct special investigations, provide judiciary security services for Utah’s Justice Courts and conduct prisoner transports. They attend the police academy, are sworn and certified special function peace officers and are officers of the court. Constables and their deputies are not tasked with general law enforcement duties, such as responding to calls for service or issuing traffic citations. Serving and enforcing civil and criminal process refers to the issuance of legal documents, orders, and writs to defendants, witnesses and other named individuals. These tasks must be performed by a constable or sheriff in several situations. Such process commonly includes summons and complaints, informations, protective orders, stalking injunctions, subpoenas, arrest warrants, writs, eviction orders, and orders to show cause. While constables and their deputies have a primary city or county, they possess statewide jurisdiction and have police authority during the commission of their duties.
